A judge in Vermont has refused to admit into evidence a three-year-old piece of chicken three former Kentucky prison inmates claim was bad. Christopher Butts of Killingly, Conn., says the chicken made him sick, and Henry Butson and Corydon Cochran say they didn't become ill but are seeking emotional damages against ConAgra Foods Inc., maker of the chicken product. The three were in court Thursday when U.S. District Judge William Sessions refused to admit the chicken into evidence, saying it had been handled by others during the past three years. Butts testified he bit into a piece of microwaved Banquet chicken that contained pus, grain and corn after buying it at a prison store at Lee Adjustment Facility in Beattyville, Ky., in November, 2005. The judge says he will issue a ruling at a later date. |
