LEXINGTON, Ky.
Two Kentucky men who hanged an effigy of President-elect Barack Obama on the University of Kentucky campus could have their case heard by a Fayette County grand jury.
Defense attorney Fred Peters said 22-year-old Joe Fischer and 21-year-old Hunter Bush waived their right to preliminary hearing on Monday. Peters said they opted instead to take their case directly to a grand jury in hopes that the charges will be dismissed.
Peters said the men were criminally charged for what he called "a political prank." They were arrested after the effigy was found hanging from a tree over a walkway in late October.
Commonwealth's Attorney Ray Larson declined to say whether he will present the case to a grand jury.
